Question by : Can the state take my child away based on alledeged drug use?
The father of my child was accused of drug use and is not using any drugs. He occasionally drinks. If the family service worker has nothing to go off of besides accusations how i she able to take our son into foster care? Dad also lives in Texas and I am in WI. She has no other reasons to take the baby.
There is 100% no proof. No record. No evidence lying around. I never have used any drugs so the baby is clean as well. This literally makes no sense.

Only if they can convince a judge that you actually using drugs or are otherwise unable to adequately care for the child.
